Thank you for using Pumpstar.app. Our commitment is to provide a Medela Symphony® Plus Breast Pump to you as quickly as possible. 

Sale Contract Conditions

You hereby certify that you are at least 18 years of age, and that you are renting the Medela Symphony® Plus Breast Pump(s) shown on the checkout page from Pumpstar.app. You also certify that you are the account holder of the debit or credit card used for the rental transaction shown on the order or that you are an authorized user who has been given permission by the account holder to use the card. Your completion of the rental transaction constitutes your acceptance of these terms. 

Condition of Pumps

Medela Symphony® Plus Breast Pumps rented from Pumpstar.app are guaranteed to be correct according to your order, and in a specialty sanitized usable condition. You must supply Medela Symphony® Plus attachments to operate the pump. 

Communication

Pumpstar.app will send you notifications and order receipts to the email address(es) you have provided. Pumpstar.app may send you return notifications via email as a courtesy, but Pumpstar.app is not responsible to notify you in any way of the return due date. You are solely responsible for returning the Medela Symphony® Breast Pump(s) by the due date whether or not you receive a reminder notification from Pumpstar.app or not. Returning or renewing your rental is important so Pumpstar.app can make pumps easily available to those who need them. 

You authorize Pumpstar.app to send you emails and/or SMS text messages that include information about discounts, deals, products and services. You may unsubscribe from these communications at any time.  Pumpstar.app may use information about you, including personal information and the information you provide for your rental transaction and/or online account creation to: (1) allow you to participate in features offered or to provide related customer service, such as responding to your questions, complaints or comments; (2) customize content recommendations and offers displayed to you; (3) process a transaction you initiate; (4) provide you with information, products or services; (5) send you special offers from Pumpstar.app and its advertisers, or its third-party business partners; (6) process your registration for rental services, including verifying your e-mail address is active and valid; (7) improve the services and for internal business purposes; (8) contact you with regard to any use of the services and, in its discretion, make changes to policies; (9) for purposes disclosed at the time you provide your information or otherwise give your consent. 

Pumpstar.app will not ask you for any personal information, account username, and password, or any of your credit or debit card information via email or text message, and you will not provide such information via email or text message. 

Pumpstar.app will have no responsibility for any misuse of such information if you provide such information via email or text message. 

Agreement to Return Medela Symphony® Plus Breast Pump(s)

You agree to return the rented Medela Symphony® Plus Breast Pump(s) in its special fitted case to the location you originally picked it up. 

You agree to continue to be responsible to pay rent until the Breast Pump is returned to the original location.

Pumpstar.app pumps are not to be taken out of the United States of America. 

Extending your rental time

You may extend your rental by re-applying and paying for your pump in the Pumpstar.app prior to the original return date. If the pump is not returned by the return date and you did not re-apply, you authorize Pumpstar.app to continue using the payment method you supplied for an extension at the same original amount for either the 7 day or 1 month option. On your due date your card will be automatically charged $29+tax or $99+tax, and you will have a new due date. 

To end your rental, on your new due date, return your pump to the original location. 

No partial weekly or monthly refunds. 

Medela Symphony® Plus Breast Pump(s) not Returned on Time 

If the Medela Symphony® Plus Breast Pump(s) are not returned at the end of the rental period, as specified in the rental agreement, one of two things will occur 1) you will be notified via email or SNS text verified by email, that your card will be charged for a 1 month rental extension of the Medela Symphony Plus Breast Pump(s). 

If the Breast Pump(s) is not returned by the end of the 1 month extension that Pump Star.app initiated due to the late return, we will share your information with our contracted agency to pursue charges and collection of our property. We will pursue collections efforts including recovering the Breast Pump or the value of the Breast Pump(s). 

You hereby authorize Pumpstar.app to charge your debit or credit card in the event of late or unreturned Medela Symphony® Plus Breast Pump(s) for rent using the monthly rate of $99+rax set forth herein for each month that you fail to return the Breast Pump and/or for the fair market value of the Symphony® Plus Breast Pump. 

The fair market value of the Medela Symphony® Plus Breast Pump(s) is determined to be the value of the breast pump at the time it was initially rented; not the value at the time the card is charged. 

We work very hard to resolve every return discrepancy. After all, our wish is to keep you as a happy customer and continue to rent Breast Pump(s) to all who need to use them. 

Maintenance and Care of Medela Symphony® Plus Breast Pump(s)

You, the renter, agree to keep Medela Symphony® Plus Breast Pump(s) in good, usable condition. Upon your receipt of the Breast Pump until you return the Breast Pump to Pumpstar.app you are responsible for keeping the pump in good working condition and to use only as directed by the instructions. In the event that the pump has been damaged by you due to abuse, misuse or alterations, you give authorization for Pump Star.app to charge you the full fair market value of the pump.

Right to Cancel Orders 

Pumpstar.app retains the right to cancel or refuse any order that results from an error in pricing due to typographical errors, miscommunication with our partners, or any other incorrect information. 

Refund and Return Policy

Unfortunately, the nature of our service does not allow refunds or returns. 

Liability 

Pumpstar.app shall not be held liable for any damages incurred, physical or emotional, tangible or intangible, for use of this rental.

Extensions 

To extend your return date, go back to the Pumpstar.app and put in a new rental. 

Collections 

You agree that you will not cancel or exceed the purchasing limits of the credit or debit card you provided until the rented Medela Symphony Plus Breast Pump(s) is either returned to Pumpstar.app or the non-return fees are paid. If the credit or debit card is declined, your account will be suspended and sent for collection purposes. You authorize Pumpstar.app pass your information to any Third Party Collection Agency. You will be responsible for paying all reasonable fees, costs or collection fees assessed by Pump Star.app or the Third Party Collection Agency.

Pumpstar.app will make reasonable efforts to process transactions in a timely manner. You agree not to hold Pump Star.app responsible in the event Pump Star.app does not credit or debit your credit or debit card for a period of time due to circumstances beyond its control. Pumpstar.app makes no guarantees regarding the processing time for charges.

In order for Pumpstar.app to service your account or to collect any amount you may owe, you agree, unless otherwise prohibited by applicable law, that Pumpstar.app or a designated Third Party Collection Agency are authorized to (i) contact you by telephone at the telephone number(s) in the patron contact account information you are providing, including wireless telephone numbers, which could result in charges to you, (ii) contact you by sending text messages (message and data rates may apply) or emails, using any email address you provide and/or (iii) contact you using pre-recorded/artificial voice messages and/or use of an automatic dialing device, as applicable. You acknowledge that you have read this disclosure and agree that the Third Party Collection Agency may contact you as described above. 

Except as otherwise provided herein, Pumpstar.app agrees to keep all your personal and payment information confidential in accordance with our privacy policy. 

Pumpstar.app may assign this agreement to a parent or affiliate company at its sole discretion. 

PUMPSTAR.APP WARRANTS TO REPAIR OR REPLACE ANY EQUIPMENT WHICH IS OR BECOMES DEFECTIVE UNDER NORMAL USE. WE WILL NOT BE LIABLE FOR INCIDENTAL, PUNITIVE, CONSEQUENTIAL OR ANY OTHER DAMAGES RESULTING FROM DEFECTIVE EQUIPMENT; OUR LIABILITY IS LIMITED TO REPAIR OR REPLACEMENT OF THE EQUIPMENT. THIS WARRANTY IS GIVEN IN LIEU OF ALL OTHER WARRANTIES EXPRESSED OR IMPLIED.
